1. About ScienceUtsav and these Terms

1.1 These Terms and Conditions govern your access to and use of our website, www.scienceutsav.com, our online store at scienceutsavstore.com, our learning management system (LMS) and other online platforms, and the purchase or use of our products and services. They are offered by SCIENCEUTSAV EDUCATIONAL SERVICES PRIVATE LIMITED, a Private Limited Company with its registered office at Floor No.: 1st, Floor Building No./Flat No.: 11 Road/Street: 19th A Main Road, Nearby Landmark: Venkataramanaswamy Temple, Locality/Sub Locality: J P Nagar 2nd Phase Marenahalli City/Town/Village: Bengaluru, District: Bengaluru Urban, State: Karnataka, PIN Code: 560078 (29ABACS9853P1ZC), which operates the ScienceUtsav brand (“ScienceUtsav”, “we”, “us” and “our”).

1.2 “Services” includes our STEM and science programmes, robotics, coding and AI programmes, the C-STEM curriculum and learning resources, science, maths, tinkering and maker labs, science clubs, festivals, summer and winter camps, weekend clubs, science parties, workshops, design-thinking and skill workshops, teacher training, LMS access, memberships and annual plans, bulk purchases, CSR and NGO programmes, and reseller, distributor, franchise and activity-centre opportunities. “Products” means the kits, learning materials and other physical goods we sell. “You” means anyone who uses our website or buys or uses our Products or Services, including a parent, guardian, student, teacher, school or other organisation.

1.3 By using our website, creating an account, placing an order, booking a Service or accepting a proposal, you agree to these Terms. At registration and checkout we ask you to confirm this by ticking a box. If you do not agree, please do not use our website or Services. If you act for a school, company, NGO, CSR partner or other organisation, you confirm that you are authorised to bind it.

1.4 A quotation, order form, proposal, school or partner agreement, event rule, consent form or product warranty may contain terms specific to a Service. Those terms form part of your agreement with us and prevail over these Terms if there is a direct conflict for that Service. These Terms, our Privacy Policy and any such document together form the entire agreement for the relevant Service and replace earlier discussions on the same subject.

1.5 Our Privacy Policy explains how we collect, use, share and protect personal data, including data about children and parents. Please read it together with these Terms.

2. Eligibility, children and parental responsibility

2.1 You must be 18 or older and legally able to enter into a contract to buy a Product or Service, book a programme or create an account. A person under 18 (a “child”) may take part only with the consent of a parent or legal guardian (or of a school or other authorised adult that arranges the child’s participation), and with supervision where these Terms or the programme require it. The adult who arranges a child’s participation accepts these Terms on the child’s behalf.

2.2 When you register a child, you confirm that:

  • you have the legal authority to give consent for the child;
  • the information you provide is accurate;
  • you have told us about any medical condition, allergy, learning need or accessibility need that is relevant to safe participation, and given us a working emergency contact; and
  • the child will follow the safety instructions and conduct rules we communicate.

2.3 Parents and guardians decide whether a programme, activity or Product is suitable for their child, using the age and safety guidance we publish. They are responsible for supervising the child outside sessions that ScienceUtsav directly supervises, including with take-home kits and online sessions.

3. Accounts and access

3.1 You must give complete, accurate and current information when you register, enquire, create an account or buy, and keep it up to date. We may reject, suspend or cancel a registration that contains false, incomplete or misleading information.

3.2 Account credentials are personal. Do not share them, except with a parent, guardian or authorised institutional administrator where the Service permits. You are responsible for activity under your account unless it results from a security failure within our control. Tell us promptly if you suspect unauthorised use.

3.3 Online Services need a suitable device and internet connection, which you arrange at your own cost. We may suspend access briefly for maintenance, security or to comply with the law, and will give notice where practical.

3.4 You may ask us to close your account at any time, subject to any outstanding obligations and any records we must keep by law.

4. Services, bookings and availability

4.1 Fees, schedules, locations, age requirements, class sizes, facilitators and other programme details are shown on our website, registration form, proposal, invoice or booking confirmation. Images, videos, demonstrations, specifications, outlines, learning outcomes and availability may vary by location, batch, age group, equipment, venue or partner requirements.

4.2 A website enquiry, brochure or discussion does not guarantee availability or create a binding commitment. A booking or order becomes binding when we send written confirmation, accept payment, sign an agreement or begin delivering the Service, as applicable.

4.3 We may substitute a facilitator, venue, date, format or activity where necessary, provided the core Service remains substantially equivalent. If a change is material and you cannot accept it, you may cancel and receive a refund for the part not delivered.

4.4 Please arrive on time and meet the age requirement stated for the programme. We may refuse entry to a participant who does not meet the stated age requirement, or who arrives so late that safe participation is not possible, and this does not by itself entitle you to a refund.

5. Prices, taxes and payment

5.1 Prices are shown in Indian rupees (₹) and GST unless stated otherwise at checkout, in a quotation or in an invoice. Delivery, venue, travel and third-party charges will be disclosed before you pay. If you need a GST invoice, give us your GST details when you order.

5.2 You agree to pay all disclosed fees and charges by the due date using a payment method we offer. Payments are processed by third-party payment gateways, banks and UPI providers, and their terms also apply. We do not control the security or availability of those platforms, and we are not responsible for delays, declines or unauthorised transactions caused by them, except as the law requires.

5.3 If an amount is debited but your booking or order is not confirmed, or you are charged twice, tell us within 7 days. We will check with the payment provider and either confirm your order or refund the amount.

5.4 If a price or description is clearly wrong, we may cancel the order and refund you in full. Promotional codes are valid only on the stated conditions, cannot be combined unless we say so, and have no cash value.

5.5 A price change does not affect a booking or order we have already confirmed.

5.6 For institutional customers, fees, payment milestones and validity periods are stated in the quotation, order form or agreement. If an undisputed amount is overdue after reasonable notice, we may pause delivery or access until it is paid.

6. Cancellations, refunds and rescheduling

6.1 A cancellation, refund or rescheduling policy stated at checkout, in a quotation, order form, proposal, event listing or agreement applies to that transaction. If none is stated, this section applies. Rules for returning Products are in section 7.

6.2 To cancel, reschedule or ask for a refund, email [email protected] with your order or registration details.

6.3 For programmes, camps, workshops, parties and events booked by an individual, the following refunds apply:

6.4 Failing to attend a confirmed programme does not by itself entitle you to a refund. A registration can be transferred to another participant or date only with our prior written approval.

6.5 Once customised goods have gone into production, materials have been dispatched, or digital access has been activated, fees are not refundable, except for a defective or undelivered item or part, or where the law requires.

6.6 If we cancel or reschedule a Service, for example because of too few participants, facilitator unavailability, safety concerns, government restrictions, venue problems, technical difficulties or events beyond our control, we will offer an alternative date, a replacement programme or a service credit. You may instead choose a full refund of the amount you paid for the part not delivered. We are not responsible for your incidental expenses, except where the law requires.

6.7 If we remove a participant for a serious or repeated breach of section 9, no refund is due, except where the law requires.

6.8 We will send approved refunds to the original payment method within 7 to 10 business days of approval. Your bank, payment gateway or financing provider may take additional time. We deduct only the charges disclosed in section 6.3.

6.9 Nothing in this section limits any refund or replacement right you have under consumer-protection law.

7. Products, kits, delivery and returns

7.1 Product descriptions, images and specifications are for general information. Packaging, colours, components and appearance may vary slightly. If a component is unavailable, we may substitute one of equivalent function.

7.2 Delivery. Delivery dates are estimates, not guarantees. Delays can result from courier performance, location, stock, customisation, public holidays or events beyond our control. We deliver to the serviceable locations shown at checkout. Please give a complete and accurate address. If delivery fails because the address is wrong or nobody is available, we may charge for redelivery.

7.3 Risk and ownership. Risk in a Product passes to you when it is delivered to the address you gave. Ownership passes to you when we receive full payment.

7.4 Inspection and defects. Please inspect Products promptly. Report any missing, damaged, defective or incorrect item within 7 days of delivery, or any longer period stated in a product warranty or required by law. Send your order number and clear photos or video of the item and its packaging to [email protected]. We may repair, replace, redeliver or refund the affected item, depending on the circumstances and the law. If the error or defect is ours, we bear the return shipping cost.

7.5 Change of mind. Products cannot be returned for change of mind once dispatched. / Unopened and unused Products in original packaging may be returned within 7 days of delivery for a refund of the price, less return shipping.

7.6 Any written product warranty applies in addition to your rights under law.

8. Product safety and supervision

8.1 Some of our kits contain small parts, chemicals, low-voltage electronic components with batteries, or tools. Our Products are educational and are not substitutes for professional engineering, medical or safety advice.

8.2 Use every Product only as instructed and follow the age guidance on the packaging and in the manual. Adult supervision is recommended for children under 8, and it is required wherever the instructions say so. The adult should consider the child’s age and abilities and the workspace and equipment before the activity.

8.3 Do not eat or drink any kit material or put it near the mouth or eyes. Wash hands after use, keep kits away from young children and pets, dispose of batteries safely, do not modify components, and stop using anything that is damaged. In an emergency, seek medical help immediately.

8.4 We aim to meet the product-safety, labelling and quality requirements that apply to our Products, including toy-safety standards where they apply.

9. Participation, conduct and safety at programmes

9.1 Participants must behave respectfully and follow the safety, classroom, venue and facilitator instructions given. The following is not allowed:

  • harassment, bullying, discrimination or threatening behaviour;
  • damage to equipment, materials, venues or another person’s property;
  • unsafe use of tools, chemicals, electronic components or equipment;
  • disruption that prevents others from taking part;
  • recording participants or facilitators, or a complete paid session, without permission; and
  • any unlawful or inappropriate activity.

9.2 Parents, guardians and schools must give us the information reasonably needed for safe participation and provide the supervision stated for the programme.

9.3 Drop-off and pick-up. For camps, clubs, parties and similar programmes, we release a child only to the parent or to a person named in the registration, and we may ask for identification. Please collect your child at the stated end time.

9.4 Emergencies. You authorise us to give first aid and, in an emergency, to arrange reasonable medical treatment for your child, and to contact you or the emergency contact as soon as we can. You are responsible for the reasonable cost of emergency treatment we arrange, unless the need for it arose from our negligence.

9.5 Child safeguarding. We take children’s safety seriously. Please report any concern to us. We will report child-safety concerns to the authorities where the law requires.

9.6 We may remove or restrict a participant whose conduct is unsafe, unlawful, abusive, disruptive or harmful to a person, property or the learning environment. We will inform the parent or school promptly.

10. Memberships, annual plans and digital access

10.1 Some Products and Services, such as annual kit plans, memberships and LMS access, are provided for a stated period. What is included, the start and end dates and the price are shown when you buy.

10.2 Access is personal to the registered learner or institution and cannot be transferred.

10.3 Unless we state otherwise at checkout, plans do not renew automatically. When we offer a renewal, we will tell you the renewal price and date before you pay. If we offer automatic renewal, we will ask for your separate consent, remind you before each renewal, and let you cancel before the renewal date. Recurring card or UPI payments also follow the authorisation rules of the Reserve Bank of India.

10.4 If you cancel a plan part-way through its term, section 6.5 applies to digital access that has been activated.

10.5 We may update and improve content and features. We will not materially reduce what you have paid for during the paid period without offering a fair remedy.

10.6 We aim to keep online Services reliable, but we cannot guarantee uninterrupted access. We will give notice of planned maintenance where practical.

11. Schools, NGO and CSR partners and other institutional customers

11.1 This section applies, in addition to the rest of these Terms, to schools, NGOs, CSR partners and other organisations that buy from us or enquire about our Services.

11.2 Quotations and orders. A quotation or proposal is valid for the period it states, or 30 days if none is stated. An order is confirmed when we accept your purchase order or written acceptance.

11.3 Your responsibilities. You will provide access to the venue, space, power and internet as needed, student lists, a safe environment, and, where you arrange participation, the parental consents required. Unless we agree otherwise in writing, a teacher or other responsible adult from your institution will supervise students throughout each session.

11.4 Delivery, installation and acceptance. For labs, kits and equipment we deliver or install, please inspect them within 7 days of delivery or installation and report any defect in writing. After that period the goods are treated as accepted, without affecting any warranty or your rights for defects that could not reasonably have been found earlier. Any warranty or maintenance terms are those in the quotation or agreement.

11.5 Licence for institutional use. You may use our learning materials internally, for your own teachers and students, as set out in section 14.

11.6 Student data. You confirm that you have the authority and any consent needed to give us student data. Our Privacy Policy explains when we act as data fiduciary and when we act as your data processor.

11.7 Confidentiality. Each party will keep the other’s non-public commercial information, such as pricing, proposals, designs, curricula and project plans, confidential, and use it only to evaluate or carry out the engagement. This does not prevent disclosure required by law (including audit, right-to-information and public-procurement rules), disclosure to professional advisers, or to your governing body, funder or approving authority, or information that is already public. You may compare our prices with others, but you may not give our proposals, designs or curricula to another provider so that it can reproduce our work.

11.8 Names and logos. We will use an institution’s name, logo or testimonial only with its permission. You may not use ScienceUtsav’s name or logo without our permission, except as an agreement allows.

11.9 Reports. For CSR and NGO programmes, we will provide programme reports and impact information as agreed in writing.

12. Reseller, distributor, franchise and activity-centre enquiries

12.1 An enquiry, application or discussion does not create an agency, franchise, distributorship, reseller, partnership, employment or exclusive-territory relationship. Any such relationship requires a separate written agreement signed by authorised representatives of both parties.

12.2 Until then, you have no right to use the ScienceUtsav name, logos or materials, or to represent that you act for us. We may accept or decline any application at our discretion. Pricing and commercial terms we share are confidential.

12.3 Bulk and wholesale purchases are on the terms we quote, and sections 5, 6, 7 and 8 apply unless the agreement says otherwise.

13. Photographs, recordings and publicity

13.1 We may photograph or record programmes and events for safeguarding, quality, training, reporting and promotion.

13.2 We use an identifiable image, voice, work or testimonial of a child for promotion only with the consent of the child’s parent. Where a school arranges parental consent, we rely on the consent the school confirms to us. Consent to promotional use is optional, and declining it will not prevent participation, unless recording is essential to a specific event and we tell you so in advance.

13.3 You can withdraw consent for future promotional use by contacting us. Section 6 of our Privacy Policy explains what happens to material that has already been published.

13.4 Participants and visitors must not photograph or record other people without appropriate permission. Personal photography at public events must respect venue rules, privacy and safety.

14. Intellectual property and licence

14.1 The website, the ScienceUtsav name and logos, programme designs, curricula, manuals, workbooks, worksheets, lesson plans, experiments, videos, software, LMS content, graphics, photographs, Product designs and training resources are owned by or licensed to ScienceUtsav and protected by intellectual-property law.

14.2 Subject to payment and these Terms, we give the registered user a limited, non-exclusive, non-transferable, revocable licence to use the learning materials we supply for personal, non-commercial educational use, or for the internal institutional use described in your quotation or agreement (for example, use by a school’s own teachers and students at the school).

14.3 You may not copy, resell, upload, broadcast, distribute, publish, modify, reverse engineer, sublicense, use to train a competing service, or commercially exploit our materials without our written permission.

14.4 Buying a Product or joining a programme does not transfer intellectual-property rights to you. A model or item that a child builds from a kit belongs to the child to keep and use.

15. Student work and content you submit

15.1 A student keeps ownership of the original work the student creates. The student and the authorised adult give ScienceUtsav a limited licence to host, display and process that work only as needed to provide the Service, including showing it to the student’s parent, teacher and school. Promotional or public use of identifiable student work needs consent as described in section 13.

15.2 You confirm that content you submit (such as messages, reviews, feedback and project files) is accurate where it states facts, is your own or properly licensed, does not infringe anyone’s rights, and is not unlawful, harmful, abusive, discriminatory, obscene, misleading or malicious. You remain responsible for it.

15.3 You give us a non-exclusive, worldwide, royalty-free licence to store, reproduce and use submitted content only to operate, support, secure and improve the Service and to meet legal obligations.

15.4 We may remove content that breaches these Terms or the law. To complain about content or report an infringement, write to the Grievance Officer (section 27) with the details. We will acknowledge within 24 hours and aim to resolve the complaint within 15 days.

16. Website use and acceptable use

You may use our website and Services only for lawful purposes. You must not:

  • use them for an unlawful, fraudulent, unsafe or unauthorised purpose;
  • try to gain unauthorised access, bypass security, probe for vulnerabilities, introduce malware, scrape protected content or disrupt our systems;
  • impersonate another person, submit false or defamatory information, or misuse another person’s account or personal data;
  • harass participants or staff, publish confidential information, or infringe privacy, intellectual-property or other rights; or
  • resell, sublicense or commercially exploit access or materials, unless a signed agreement expressly permits it.

We may restrict or end access where we reasonably suspect misuse or unlawful activity.

17. Third-party services and links

Our website and Services may link to or depend on third-party platforms, payment providers, delivery partners, video services, social-media platforms and other websites. Those third parties control their own content, availability, security and terms, and your use of them is subject to their terms and policies. We are responsible for couriers, venues and facilitators that we appoint to deliver our Services, but not for independent third-party services outside our control, such as your bank or a social-media platform.

18. Educational disclaimer and warranties

18.1 We will provide paid Services with reasonable care and skill and Products in line with their description and any written warranty. Except for rights that cannot legally be excluded, our website and free resources are provided “as available” without further warranties.

18.2 Learning depends on attendance, participation, age, prior knowledge, practice, supervision and other factors. We do not guarantee specific grades, competition results, admissions, certifications, employment, career or commercial outcomes, that every programme suits every participant, uninterrupted access to online features, or that website content is always complete, current or error-free.

18.3 Certificates we issue confirm participation in or completion of our programmes. They are not academic qualifications or accreditations unless we say so in writing. When we describe our content as mapped to CBSE, ICSE or another board’s syllabus, we mean it aligns with the topics covered. It does not mean that any board has approved or endorsed our Products or Services.

19. Limitation of liability

19.1 Nothing in these Terms excludes or limits liability that cannot lawfully be excluded. This includes liability for fraud, wilful misconduct, death or personal injury caused by negligence, liability for defective Products under consumer-protection law, and any right you have as a consumer that the law does not let you waive.

19.2 Subject to section 19.1 and to the extent the law permits, we are not liable for indirect, incidental, special, consequential or punitive loss, or for lost profits, revenue, opportunity, goodwill or data arising from our website, Products or Services.

19.3 Subject to section 19.1, our total liability for any claim will not exceed the amount you paid for the specific Product or Service that gave rise to the claim in the twelve months before the event.

19.4 To the extent a loss is caused by incorrect information from a participant, parent, customer or partner, by failure to follow the instructions or safety requirements we gave, or by unauthorised modification or improper use of a Product or material, we are not responsible for it.

20. Responsibility for breach

20.1 You are responsible for direct loss that we reasonably suffer because of your unlawful use of the website or Services, your material breach of these Terms, content you submit that infringes another person’s rights, or false information you give us.

20.2 An organisation is also responsible for use of accounts it administers and for the conduct of its staff and students, and agrees to cover third-party claims arising from its unlawful use or from content it submits that infringes rights.

20.3 This section does not make a consumer responsible for loss caused by ScienceUtsav, or for any liability that the law does not allow to be passed on.

21. Suspension and termination

21.1 We may suspend or end your access to our website, accounts or Services when reasonably necessary because of non-payment (after reasonable notice), a security risk, unlawful activity, serious misconduct, infringement or a material breach of these Terms. Where appropriate, we will give notice and a reasonable chance to fix the problem, except where safety or security needs immediate action.

21.2 If we end a paid Service for a reason other than your breach, we will refund the prepaid amount for the part not delivered.

21.3 You may stop using the website at any time, and may ask us to close your account (section 3.4).

21.4 Ending access does not affect rights, payments or obligations that arose earlier. Terms on payment, confidentiality, intellectual property, liability, responsibility for breach, and governing law and disputes, and any term that is meant to continue, survive termination.

22. Events beyond our control

Neither party is liable for delay or failure caused by circumstances beyond its reasonable control, including natural disasters, extreme weather, epidemics or public-health restrictions, war, civil disturbance, government action, transport disruption, power or internet failure, labour disputes, venue closures and supply-chain interruptions. This does not excuse payment for Services already delivered. The affected party will take reasonable steps to reduce the impact and resume performance. If we cannot deliver a Service, section 6.6 applies, and this section does not remove any refund or other right that cannot be excluded by law.

23. Changes to these Terms

We may update these Terms to reflect changes in our Services, business practices or legal obligations. We will post the updated Terms on this page with a new “Last Updated” date. For material changes, we will also give notice on our website and, where we hold your email address, by email. Changes apply from the date they are posted and do not affect completed purchases or confirmed bookings, unless the law requires it or you agree.

24. Notices

We may give you notice by email, phone, WhatsApp, on our website or platform, or to the postal address you gave us, and an email is treated as received when sent unless we get a delivery-failure message. Please keep your contact details up to date. You may give us notice by email to [email protected] or by post to our registered office.

25. Governing law, complaints and disputes

25.1 These Terms are governed by the laws of India.

25.2 Complaints. If you have a complaint, please contact our Grievance Officer using the details in section 27. We will acknowledge it within 48 hours and aim to resolve it within one month. You may also approach the National Consumer Helpline (1915) or a consumer commission at any time.

25.3 Disputes. Both parties should first try in good faith to resolve a dispute by written notice and discussion. If it is not resolved, the courts at Bengaluru, Karnataka have jurisdiction, subject to any consumer forum or other jurisdiction available to you under law, including where you live or work.

25.4 Nothing in this section prevents either party from seeking urgent interim relief from a competent court or using a statutory consumer grievance mechanism.

26. General provisions

26.1 If any provision of these Terms is found invalid or unenforceable, it will be limited or removed only as far as necessary, and the rest will continue.

26.2 If we do not enforce a right, that is not a waiver of it.

26.3 You may not assign your account or any agreement with us without our written consent. We may assign our rights and obligations as part of a reorganisation or transfer of business, as long as this does not reduce your mandatory consumer rights.

26.4 Headings are for convenience only, and these Terms are written in English.
